NSSF Funded Lawsuit Seeks Emergency Preliminary Injunction to Block Virginia’s Gun, Magazine Ban Law
WASHINGTON, D.C. — Plaintiffs challenging Virginia’s ban on the sale of Modern Sporting Rifles (MSRs) and standard-capacity magazines filed an emergency motion for a preliminary injunction to block the Commonwealth from enforcing its unconstitutional law. The motion and the challenge to the law, funded by NSSF®, The Firearm Industry Trade Association, were filed with Virginia’s Circuit Court of Fauquier County.
Plaintiffs in the challenge, including Erick Black, Britton Condon, Clark’s Gun Shop, Optimus Arms, LLC and Hexmag USA, LLC, allege that Virginia’s law violates both the U.S. and Virginia Constitutions. The plaintiffs further requested a hearing on the motion for injunction by June 19, 2026, before the effective date of July 1, 2026, when Virginia’s ban on the sale of the most popular-selling centerfire rifle in America will be enforced.
“This law is unconstitutional and allowing it to be enforced would rob law-abiding citizens of Virginia of their rights protected by both the Virginia’s Constitution and the U.S. Constitution,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “Governor Abigail Spanberger admitted in her statement when she signed the law that she knew it banned popular hunting guns. Allowing this law to be enforced while it is being challenged in court would cause irreparable harm to law-abiding Virginians who seek to exercise the full spectrum of their civil liberties.”
The emergency motion details that plaintiffs — including a former Green Beret, a decorated clay shooter, a firearm retailer, a firearm manufacturer and magazine manufacturer — would suffer irreparable harm to the free exercise of their Second Amendment rights and livelihoods. The motion argues that the U.S. Supreme Court, in Heller, previously held that bans of firearms in common use violate the Second Amendment. There are over 32 million MSRs in circulation in America today and conservatively estimated nearly 1 billion detachable magazines in private possession and hundreds of millions with capacity exceeding 15 rounds.
Additionally, Virginia’s law fails the Supreme Court’s Bruen test, as there is no historical tradition for bans on entire classes of firearms when the Second Amendment was adopted in 1791. In fact, the motion details that Virginia’s first settlers in Jamestown, nearly to a man, were armed with firearms.
Virginia’s law banning the sale of MSRs and standard-capacity magazines sweeps up all manner of common semiautomatic rifles, pistols and shotguns. It includes any semiautomatic rifle that can accept a detachable magazine and one or more prohibited cosmetic characteristics that have no bearing on the function of the firearm. Many of those features add to the safe-handling and accuracy of the firearm.
The law also sweeps in semiautomatic pistols with two or more prohibited characteristics, many of which are designed for increased safety and accessibility for individuals with physical limitations. Likewise, the law includes certain semiautomatic shotguns, which are ubiquitous among hunters and youth hunters.
Violations of Virginia’s sweeping bans will be a Class I misdemeanor offense that carries a sentence of one year of imprisonment and a $2,500 fine. This is not an insignificant infraction.

Big Horn Armory (BHA) Removed from YouTube
Wyoming-based big-bore rifle manufacturer appealed strikes in vain as the platform terminated its channel after a retroactive application of a new firearms handling policy.
Cody, Wyo. (May 2026) – Big Horn Armory (BHA), makers of big-bore firearms, announced today that YouTube has permanently removed the company’s channel from its platform. The termination follows three strikes issued against videos that had been posted more than two years prior without incident, each cited as violations of the platform’s updated firearms policy.
The videos in question were routine, non-instructional content that included demonstrations such as shooting frozen chickens. They contained no instructions for manufacturing or modifying firearms, no sales solicitation, and no content that would have violated YouTube’s long-standing community guidelines at the time of posting. The company assesses that the strikes were the result of retroactive policy changes that now classify the mere handling of a firearm as a policy violation in certain contexts.
YouTube’s current firearms policy states, in part, that the platform does not allow live streams showing someone holding, handling, or transporting a firearm. The policy’s application appears to have expanded over time in ways that have affected pre-existing content that was compliant under prior standards.
Big Horn Armory pursued the platform’s formal appeals process following the first strike and had successfully appealed similar actions in the past. This time, all appeals were denied. Upon reviewing YouTube’s revised policy in full, company leadership determined that further appeals were unlikely to succeed, as the updated language appeared to prohibit the type of firearms-handling content that is central to virtually all of Big Horn Armory’s video library.
“We are a federally licensed firearms manufacturer. We operate legally and transparently, and we have done so since our founding. We did not change our content. The platform changed its standards and applied them retroactively to videos our community had watched for years without issue,” said Greg Buchel, Owner of Big Horn Armory. “At a certain point, continuing to appeal a policy that is written to exclude us made no sense. We accept what has happened, and we are moving forward.”

NSSF Funds Lawsuit Against Virginia for Unconstitutional Firearm Bans
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, is funding a lawsuit filed today against the Commonwealth of Virginia for violating both the U.S. Constitution and the Virginia Constitution. Virginia’s expansive new law, HB 217 / SB 749, bans the sale and transfer of firearms that are expressly protected for private ownership by both the federal and state constitutions.
“Governor Abigail Spanberger, and the Virginia General Assembly, are grossly violating rights held by the citizens of the Commonwealth. The constitutions of the United States and the Commonwealth of Virginia expressly prohibit the government from infringing on the right to keep and bear arms,” said Lawrence G. Denying law-abiding citizens the ability to protect themselves with the firearms of their choosing does nothing to make Virginia safer. The only thing this unconstitutional law does is surrender the freedoms that the Founding Fathers, including Virginians George Washington, Thomas Jefferson and James Madison — who authored the U.S. Constitution’s Second Amendment — so wisely fought for and sought to protect to ensure freedom from tyranny.”
The NSSF-funded complaint, filed by Erick Black, Britton Condon, Clark’s Gun Shop, Inc., Optimus Arms, LLC and Hexmag USA, LLC, in Virginia’s Circuit Court of Fauquier County, details that HB 217 / SB 749 criminalizes not just the sale or transfer of commonly-owned Modern Sporting Rifles (MSRs) and standard capacity magazines, but also commonly owned handguns and shotguns Virginians regularly use for self-defense and hunting. The overly broad definitions of what is wrongfully defined as an “assault firearm” disenfranchise Virginians of their right to keep and bear arms, which are protected by the U.S. Constitution’s Second Amendment and Article I of the Virginia Constitution.
The U.S. Supreme Court’s Heller decision held that firearms in common use are protected by the Second Amendment. That holding precludes bans on the legal sale of MSRs, which number over 32 million in circulation. Likewise, there are a conservatively estimated nearly 1 billion detachable magazines in private possession and hundreds of millions with a capacity exceeding 15 rounds. Many commonly owned pistols are equipped with 17-round magazines, which HB 217 / SB 749 now criminalizes. The law’s expansive definition of “assault firearm” wraps in many commonly owned semiautomatic shotguns and handguns, which will be unlawful to purchase or bear in Virginia.
Virginia’s HB 217 / SB 749 fails the Supreme Court’s Bruen “history and tradition” test, as there were no analogous laws banning the lawful acquisition or bearing of firearms at the Nation’s founding. In fact, it is well documented that rifles with a capacity greater than 15 rounds were available and possessed by Americans when the Second Amendment was adopted in 1791.
Additionally, because HB 217 / SB 749 bans rifles, pistols and shotguns commonly used for hunting, it violates Article XI, Section 4 of the Virginia Constitution.
