NSSF Submits Public Comments Against Biden Administration Proposed ‘Engaged in the Business’ Rule

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, submitted a 28-page comprehensive public comment letter detailing the pitfalls of the Biden administration’s proposed “Engaged in the Business” rule that would create criminal law through executive fiat. The proposed Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rule, published Sept. 8, would redefine individuals considered to be “engaged in the business” of selling firearms, requiring nearly any individual selling more than one firearm to obtain a federal firearms license (FFL) and move the United States toward universal background checks, which was rejected by Congress.

“Respectfully, ATF lacks the legal authority to do so,” wrote Lawrence G. Keane, NSSF’s Senior Vice President and General Counsel in the public comment letter.

“The Proposed Rule exceeds ATF’s limited authority to adopt regulations. In enacting the Gun Control Act of 1968, Congress rejected making a violation of a regulation a crime,” the letter reads. “In enacting the Firearm Owner’s Protection Act of 1986, Congress further reduced ATF’s regulatory power. The specificity of authorized regulations negates a broad power.”

Keane added, “ATF has no authority to ‘improve’ on what Congress enacted or to create new crimes not enacted by Congress. An agency may not re-write statutory terms or fill in what the agency considers to be ‘gaps’ or ‘loopholes’ in the statute. The GCA is a criminal statute, and ATF’s reading is not entitled to any deference. Given that the GCA is a criminal statute with the same meaning in a civil context, ATF may not create presumptions thereon for civil or administrative purposes.”

NSSF warns ATF in the public comment letter that the Proposed Rule would invite unintended consequences that would be detrimental to the ATF’s law enforcement and regulatory missions. The Proposed Rule would create an untold number of licensees, divert ATF resources away from providing necessary industry services, distract ATF from bona fide criminal investigations and harm both the legitimate firearm industry and ATF operations.

NSSF has been critical of Final Rules enacted by the Biden administration that have bypassed Congress to create criminal law through Executive overreach, including the ATF’s Final Rules on Frames and Receivers and Stabilizing Pistol Braces. Those rules are under legal scrutiny by U.S. Courts of Appeal.

New AI-Based Solar-Powered Robot Boat for Endless Recon

The Royal New Zealand Navy will soon receive its first 6.8-meter renewable-powered Uncrewed Surface Vessel (USV) for trial. Called “Bluebottle,” it is meant to provide persistent surveillance around the waters of New Zealand for fishery protection, border protection, or meteorological data.

Once operational, “Bluebottle” will set out to perform its maritime tasks without fuel or personnel on its planned seven-month-long trial. According to Interesting Engineering, the USV uses a retractable rigid sail for wind propulsion, powered by photo-electric cells on the sail. It is equipped with a special flipper and rudder mechanism that allows it to navigate and move forward even in the absence of sunlight and wind, can reach a maximum speed of five knots, and operate at sea indefinitely (even in rough conditions with wave heights of six to nine meters).

Safe and effective system control and vessel identification are enabled by sensors like radar, electro-optic, and infrared cameras. The USV will be monitored and operated from a control room located at Devonport Naval Base, which will communicate with it through mobile phone signals when the USV is close to the shore and via high- and low-bandwidth satellites when it is further offshore.
The RNZN’s Commander of Autonomous Systems Commander Andy Bryant expressed his excitement for witnessing the potential of the USV, stating: “The Bluebottle has already undertaken a range of activities in support of the Australian Government for long [periods] without the need for refueling, recharging, or crew respite.” He added that he is confident that they will see similar benefits from the time they have with the vessel, particularly a better understanding of how to operate and sustain uncrewed vessels.

In terms of launch and carrying, the USV can be transported by trailer to almost anywhere in New Zealand, where it can be launched and recovered from a boat ramp. It can also be craned on and off a Navy ship to launch operations while deployed overseas.

Major General Har-Even has agreed to extend his tenure in response to the board’s request, due to the ongoing “Swords of Iron” war ensuring a smooth transition with the incoming CEO.

The 9mm polymer, striker-fired pistol offers users a snag-free carry in a low-profile design with superior ergonomics. Combined with the Quick-Sight™ System, which places both the front and rear sights on a single focal plane, the Enhanced F achieves target acquisition incredibly fast, even on second shots. All metal parts are QPQ nitride with an enclosed post-oxidizing surface treatment for increased durability and protection against wear and corrosion. Enhanced F barrels are SAAMI proof tested for +P ammo. The trigger shoe, trigger safety, and trigger bar are combined into a one-piece, multi-function unit (MFU) which is designed to create an extremely intuitive pistol for shooters of all skill levels.

The Enhanced F, designed with a combative edge, incorporates features that enable the user to act fast, even in the closest of encounters with low felt recoil. Ergonomically developed with a high, deep tang, the pistol feels like an extension of the user’s arm, and the snag-free exterior allows for rapid draw without catching on clothing or gear. The rear slide serrations provide a positive grip space for single-hand racking. The pistol also accepts accessories, lasers, and lights on the 1913 Picatinny rail forward of the trigger guard.

The Enhanced F pistol provides full pistol power in a smaller, low-mass package: perfect for civilians, concealed carry, or on duty. Tested and tried, the Enhanced F delivers smooth handling and accurate shooting consistently with every shot.

Delivery of New Block 5 and GCS Part of Mid-Life Modernization of ItAF’s RPA Fleet

SAN DIEGO – 05 December 2023 – On Nov. 9, 2023, the Italian Air Force (ItAF) made its first flight of a new MQ-9A Block 5 Remotely Piloted Aircraft (RPA) built by General Atomics Aeronautical Systems, Inc. (GA-ASI). The new RPA was delivered to the ItAF, along with a new Mobile Ground Control Station (MGCS), as part of a Mid-Life Modernization (MLM) update to the ItAF fleet of RPAs from GA-ASI. The aircraft and MGCS are part of a Foreign Military Sale.

The Block 5 RPA provides a significant increase in electrical power generation, auto takeoff and landing capability with improved landing gear and datalinks, and the latest version of the GA-ASI Lynx® Multi-mode Radar.

“The Italian Air Force has long been a leader in using the MQ-9 Reaper to support a wide range of Intelligence, Surveillance, and Reconnaissance (ISR) missions in Italy, over the Mediterranean, and in support of NATO operations,” said GA-ASI Vice President of International Strategic Development Jaime Walters. “The delivery of this new Block 5 and MGCS will help to update the Italian Air Force’s existing fleet.”

The ItAF’s current fleet of RPAs from GA-ASI consists of four Block 1s and two Block 15 MGCSs.

FAA Launches 2023 Holiday “12 Days of Drones” Safety Campaign

WASHINGTON – If you are considering a drone as a holiday gift, the Federal Aviation Administration (FAA) wants you and your loved ones to understand how to fly it safely.

The FAA is launching its 12 Days of Drones campaign to educate people about the rules, regulations and best practices of operating a drone. This December, the agency will share important drone-safety information and resources that will help future pilots stay up to date with the latest rules. All of the campaign’s safety messages will be posted on the FAA’s DroneZone Twitter and Facebook accounts throughout the month.

The campaign will run each weekday from December 7 – 22 with each day dedicated to a specific drone safety topic.
