NSSF Statement on Connecticut Supreme Court Ruling in Soto v. Bushmaster

NEWTOWN, Conn. — The Connecticut Supreme Court today reversed (4-3) a state Superior Court ruling and decided in Soto v. Bushmaster that the case can go forward based on the plaintiffs’ allegation that the defendants marketing and advertising of a legal product somehow violated Connecticut’s Unfair Trade Practices Act (CUTPA). The Court’s split decision held that CUTPA fit within an exemption to the federal Protection of Lawful Commerce in Arms Act (PLCAA) that permits lawsuits where the defendant violated a statute applicable to the sale of firearms. In a strongly worded and well-reasoned dissent, Chief Justice Robinson rejected the majority’s overly broad interpretation of the scope of the limited exception, which is contrary to legislative text, cannons of statutory interpretation and the legislative history of the PLCAA. The majority’s decision today is at odds with all other state and federal appellate courts that have interpreted the scope of the exception. As the trade association for the firearms industry, the National Shooting Sports Foundation® filed an amicus brief in support of the defendants in this case and both respectfully disagrees with and is disappointed by the court’s majority decision.

Throttle Controls Altitude and Yoke Controls Attitude

Once again we’ve made it through another week, but you have to admit that it’s been interesting but somewhat troubling. Readers, it’s not enough that Congresswoman Ocasio-Cortez has set new standards for stupidity (did you catch Timothy Sloan’s testimony in the Finance Committee) but today we see Beto O’Rourke announce a 2020 run for the White House!

Beto, should ask Columbia University for his money back; however, one thing is certain the guy is not the sharpest tack in the box. Between Beto and Ocasio-Cortez we’ve lowered human intelligence to the equivalent of a perfect vacuum. I thought that Ms. Ocasio-Cortez’s thought  processes were best described as anal extraction – boy was I wrong! Beto brings new meaning to “anal extraction.” This poor guy is telling his audience that in 12 years we will be extinct. Calling him a moron is a disservice to those afflicted by an expression of the stupid genome.

Is he a moron or is he trying to separate people who believe everything they see on social media from their wallets. Can you imagine tasking Beto with our national security? I don’t even want to think about that!

If you do feel a need to visit a therapist, I’ll understand; instead, let’s have a shoot the shit!

What I thought I’d do for this week’s shoot the shit is give you a little background to help you digest the Boeing issue. So here we go…

On landing and takeoff, the single most important parameter is indicated airspeed. You don’t want to let your indicated airspeed wonder. Let’s use a light aircraft as an example.

A Cessna 174 rotates at approximately 55 knots. You takeoff by applying full throttle and when your indicated airspeed reaches 55 knots you gently pull back on the yoke (the wheel) allowing the aircraft to liftoff the runway and become airborne (rotate). You then bring the nose of the aircraft level to the ground to pick up airspeed and achieve the best rate of climb speed, which in the Cessna 174  is about 75 knots. If you continue to hold the nose level your airspeed will continue to increase, so you allow the nose to move up in order to maintain 75 knots. As you climb, keeping the aircraft in that nose up attitude requires physical pressure on the yoke. To deal with that pressure, aircraft manufactures provide a control surface called the trim tab; by adjusting the trim tab, the pilot can relieve the pressure on the controls and sustain the best rate of climb at full power until you reach my the desired cruise altitude.

So here’s the sequence:

  1. Full throttle (starting your takeoff roll)
  2. pull up at the rotation speed (aircraft type and model specific)
  3. establish best rate a climb speed (aircraft type and model specific)
  4. trim the aircraft
  5. continue climb at full power to cruising altitude

If the aircraft is trimmed properly you can literally take your hands of the yoke and maintain your climb.

Now what can go wrong?

If the sensor that provides the indicated airspeed malfunctions,  in a manual system like the Cessna, you won’t know accurately where you are relative to your flight. You may be rotating too soon or climb at too low of a speed resulting in an aerodynamic stall (wings are not generating lift) But, as a pilot you will note that controls become spongy and unresponsive or the nose of the aircraft drops. If that happens and you pull up you’ll make matters worse. If you put the nose down to pickup airspeed but are not high enough to recover, you crash. In a manual system like that of a light aircraft If something goes wrong with the trim, You can always compensate for that with a combination of yoke and throttle.

The Boeing 737 MAX 8 the process that I’ve just described is automated using a system called M.C.A.S. When software detects that the indicated airspeed is approaching stall speed the aircraft trim system will bring the nose of the aircraft down allowing the indicated airspeed to increase preventing an aerodynamic stall. If the sensor fails or is providing  inaccurate information, software my not detect a stall condition. If a Boeing 737 stalls you will experience a steep nose down attitude producing a vertical velocity of as much as  –1,500 feet per minute. So, it appears based on what I’ve read so far, that upon detecting a stall condition, the M.C.A.S. system trimmed the aircraft’s nose down, the pilots reacted by pulling up, M.C.A.S. continues to detect a stall and applies down trim again. This sequence of events continued until the aircraft crashed.  What I don’t understand why did the M.C.S.A. system did not automatically disengage upon pilot application of stick control. It’s equivalent to your vehicle cruse control not disengaging when you apply the brakes.

I question the wisdom of the design concept but if the pilots did not manually override the M.C.A.S it points to a serious training issue.  If the airspeed sensor failed, the old computer adage “garbage in garbage out” GIGO applies and M.C.A.S. system could not function correctly. Was it hardware, software or pilot? Maybe it was all three.

NDIA supports defense budget, calls for end of Budget Control Act

NDIA supports the commitment to our nation’s defense and its warfighters signaled in the defense top line of the President’s Budget. This is a good next step in the long process of regaining military readiness while investing in modernization and recapitalization. By all accounts, that top line includes needed investments in personnel, training, research and development, acquisitions and sustainment.
The budget, however, was released without a prior bipartisan agreement overriding spending caps, putting this top line and past investments at risk. This is the result of the distorting impact of the 2011 Budget Control Act (BCA). An example of this distortion is the aggressive use of overseas contingency operations funds, which don’t count against BCA limits, to stay below the caps. The BCA has failed to drive the fiscal reforms as it was meant to do; instead, it has led to military readiness crises, acquisition delays and budget instability.
NDIA urges Congress to immediately repeal the BCA and resume normal order and a rational budget process. Budget stability, and the ability to do real long-term planning by the Defense Department and its partners in the industrial base, should be the goal and result. We also urge Congress to adhere to the $750 billion top line and the underlying investments called for to adequately resource the 2018 National Security Strategy. Our nation and its warfighters require and deserve it.

Guns arrive; Zenith begins fulfilling back orders

Afton, VA: Zenith Firearms opened its doors late Monday night to welcome its first large shipment of MKE guns in more than a year. The quantity received equips Zenith to satisfy nearly half of its current back orders. A similar shipment next quarter will satisfy remaining back orders for model Z-5RS and enable limited new sales activity.

Effective March 18, Zenith will begin accepting distributor, dealer, and consumer-direct preorders for all configurations of its Z-5RS.

A recently negotiated contract between Zenith and MKE stipulates 2019 production and delivery of models Z-3 and Z-33, in addition to third- and fourth-quarter deliveries of model Z-5P in quantities that exceed Zenith’s backlog.

We appreciate MKE’s diligence, despite a difficult last year in Turkey, to reestablish production for the U.S. market as a top priority, and to secure our ability to reliably and consistently respond to the demands of our customers going forward.

Aimpoint awarded contract for Fire Control Systems by U.S. Armed Forces

MALMÖ, Sweden – Aimpoint, the leading manufacturer and innovator of red dot sighting technology, has been awarded a USD 24 million firm, fixed-price contract for supply of the Aimpoint® FCS13-RE Fire Control System to the U.S. military. The system will be deployed as the primary Fire Control on the new M3-E1 MAAWS lightweight 84mm Carl Gustaf produced by SAAB Dynamics. The contract was awarded through Atlantic Diving Supply (ADS Inc.) via the DLA Tailored Logistics Support program.

The FCS13-RE is a direct view, Dynamic Universal Reflex Sight, which utilizes an integrated laser range finder and ballistic computer to give the gunner an aiming point corrected for range, type of munition, terrain angle, and environmental conditions. In addition to the 84mm Carl Gustaf, the system can also be utilized on other crew served weapons including 40 mm high velocity grenade launchers, and 12.7 mm (.50 caliber) heavy machine guns. The FCS13-RE provides a very high probability of first-shot hit on both stationary and moving targets at extended ranges and utilizes a very intuitive user control interface. The system can be enhanced with modular magnification and thermal imaging components and is compatible with all generations of military night vision equipment.

The selection of the Aimpoint FCS13-RE for use on the M3-E1 Carl Gustaf followed extensive tests and evaluations conducted in cooperation with the U.S. Army’s Armament Research, Development and Engineering Center (ARDEC) headquartered at Picatinny Arsenal, New Jersey.

“Having delivered over one million M68CCO close combat optics to the U.S. Army and U.S. Air Force since 1997, Aimpoint has proven to be a highly reliable supplier to the U.S. Armed Forces” said Brian Lisankie, President of Aimpoint Inc. “This latest contract for electronic Fire Control Systems shows that Aimpoint has continued to increase our technical capabilities, and to offer new cutting-edge products for use by our most prestigious military customers.”

“In combination with the new lightweight M3-E1 Carl Gustaf, the FCS13-RE greatly increases the lethality and survivability of troops in the field. Magnum Research Announces Full USA Production of Desert Eagle Pistols

Work began in 2008 to start moving manufacturing back into the United States. The first prototypes were produced in 2009 and started limited production later that year. Production began in earnest in 2010 and hasn’t slowed down since. Every year, Magnum Research has increased USA production and reduced imports. Now in 2019, the Magnum Research Desert Eagles are 100% USA made and production is on track to build over 10,000 USA models this year.

Nominations Are Now Being Accepted for the Trinity Oaks Lt. Paul Silber Award

SAN ANTONIO (March 11, 2019) —Named after a dedicated solider who overcame the limitations resulting from combat wounds to have a meaningful life after war, the Trinity Oaks is currently accepting nominations for the 2019 Lt. Paul Silber Award. The award recognizes the outstanding achievement in the areas of service to our country, philanthropy, and will recognize a community member who leads by example to fulfill the mission of Trinity Oaks. Although the recipient’s life must reflect the values of Trinity Oaks, they do not need to have been a participant, volunteer, or previously affiliated with the organization’s programs or services.

Each candidate must have served in a live combat zone. This helps them connect and understand the hardships and sacrifices other veterans experience during active duty deployment and coming home. Trinity Oaks wants to honor this process and give hope to all of our returning veterans.

Candidates must also demonstrate consistent volunteerism and service within their own community. Participation in a leadership role with the volunteer situation will be given added weight in the decision making.

Appreciation of nature and a healthy respect for the bounties of our world are a necessary trait for any candidate of the Lt. Paul Silber Award. Support of a conservation or other natural resource focused organization will be highly desirable on an application.

Applicants for  the Lt. Paul Silber Award do not have to be affiliated with Trinity Oaks, but they must demonstrate their personal beliefs are aligned with those of the organization including a respect for nature, participation in our outdoor heritage, as well as anappreciation for God and our great country.

Enforce Tac and U.T.SEC 2019: Nuremberg exhibition pairing more successful than ever

The 8th Enforce Tac, the international trade fair for command, control and operational equipment used by security agencies, and the 3rd U.T.SEC – Summit for Drones, Unmanned Technologies & Security, closed on 7 March after two very successful days. These two highly specialised events were even more closely linked this year, in terms of both location and subject matter, attracting a total of about 5,000 experts from around the world to the Exhibition Centre Nuremberg, about 35 percent more than the previous year.

The two parallel events posted an increase of about 25 percent in exhibitor numbers, with well over 300 between them. Their success was boosted by the fact the authorities are once again prepared to invest more in police equipment, along with a growing awareness of the use of, and the need for protection against, drone technology. With the strong demand for exhibition space, the new area made available in hall 12 and its foyer was almost completely filled right away.

Under the patronage of Germany’s Federal Ministry of the Interior, Building and Homeland, and the Bavarian State Ministry for Economic Affairs, Regional Development and Energy, the two events were dedicated to acute security matters such as state-of-the-art equipment for police special forces at a time of serious international crime and terrorist activities, and increasing security for critical infrastructure and major events through the use of – and by offering protection against – drone technology.

Enforce Tac and U.T.SEC will be held in parallel again next time, on Wednesday 4 and Thursday 5 March 2020, at the Exhibition Centre Nuremberg.

DOGS ARE GREAT BUT LINE THE CAGE WITH THE WASHINGTON POST

The weather is improving and the outdoors is looking great; however, please keep in mind those who lost their lives and homes in Beauregard, Al from the devastating tornado. Take a little time to explain to your children that the world is not coming to an end in 12 yrs. and that they will have a long and productive life ahead of them.

There’s so much b.s. going around, but don’t let it get to you or you’ll end up running to a jackass who studied psychology so they could understand themselves and pay at least $150 per hour for the privilege. The better alternative is to turn off social media, get a group of friends, or family members, together and have a good shoot the shit. What’s a shoot the shit you say?

A shoot the shit is a social event where any number of topics can be discussed, but unlike a business meeting, shoot the shit participants don’t need to know anything about the subject being discussed. They cam make any unsupported statement, use uncensored profanity, political corrects is out the window and they can insult anyone they wish or change the subject at any time without observing meeting protocols. Try it you’ll be pleasantly surprised. However, if you can’t get your own shoot the shit going you’re welcomed to participate in ours. So let’s get started.

If you’re concerned about the new crop of Democratic House Representatives, you should be because it’s quite likely the oath of office meant nothing to them; furthermore, there is demonstrable evidence of intellectual anemia; not to mention a marvelous economy of vocabulary. Of further concern is that other members of the Democratic House are aligning themselves with these individuals so they can get more likes on Twitter.

Imagine kicking-off a House Committee meeting with this…

Translated it means this Committee is called to order

Then, of course, you have House members that think chasing 25,000 jobs with an average salary of $150,000 per year out of town is helping their neighborhood, that the world is going to end in 12 years due to climate change, that cow flatulence is polluting the atmosphere with methane, that aircraft should be banned, that all fossil fuels must be banned, that all buildings in the U.S. must be redesigned to be Green and maybe we shouldn’t have children – folks you have to pay to be that stupid!

Just think, these new Democratic House members are being paid a fully loaded* salary of $250,000 per year. This does not include office space, staff etc. etc.

Making matters worse is a media that not only misinforms, they make no effort to be objective and informative, for example today’s morning headline from the Washington Post

 U.S. posted record-breaking $891.2 billion merchandise trade deficit in 2018, despite Trump’s ‘America First’ policies **

Headlines like these are designed to make you think that Trump’s economic policies are failing. Let’s talk about this.

Globalist policies of previous administrations have placed the U.S. economy at risk; as a result electronics, appliances, apparel, telecommunications equipment, smart devices, notebooks, laptops and semiconductor manufacturing left the United States. The Chinese, for example are doing everything humanly possible to destroy the United States’ manufacturing base. They do that through labor and currency manipulation to make Chinese products cheaper. They’re doing the same thing to the EU. We know that there are other serious issues like intellectual property rights, cyber industrial espionage and perhaps less serious, the poor quality of Chinese products.

A trade deficit exists when a country imports more than it exports. The reason why we had a high trade deficit is because people bought more. They did that because there is a higher level of employment, earnings are up and taxes are lower. When you get a raise or pay less in taxes, you go out and buy something that you’ve wanted, but  because you are buying something not manufactured in the U.S. you are adding to the trade deficit. Does that mean Trump’s policies are failing? Absolutely not! We have higher employment and incomes but we’re not manufacturing enough here. Trump is attempting to reverse that by creating a business friendly environment. One of the positive results of that policy is Apple’s decision to repatriate earnings along with moving some manufacturing to the United States, for example.

If you’re not cognizant of these things you are easily sucked into believing that Trump is failing, not even close! Economies as large as the United States’ are like ocean super tankers, it takes miles to turn them around.

Something else that the Washington Post never discusses is the fact that we are exporting more. This is the excerpt from the BEA report

“Exports of goods and services increased $148.9 billion, or 6.3 percent in 2018 to $2,500.0 billion.”

So we are selling more which is as a direct result of Trump’s trade and business policies. Donald J Trump is not failing, and when you read these publications relegate anything you read about the Trump Administration to cage liner.

On to another topic…

I was tracking when the gay community was originally classified a “gays”  then it went to LGB I was cool with that too. Then they add T no problem so far and more recently they added Q. I don’t like the Queer designation because I’ve know straight people that are pretty dammed queer but hey, I’ll go along with it.

But, what the hell is a +? Does it mean > than 1 LGBTQ

Los Angeles, March 2019 – GunLamps has launched on Kickstarter with a modest $10,000 funding goal. GunLamps was co-founded by a US Marine Corps veteran and a British Army veteran, who met in California in 2012, became best friends, and business partners. What started as a simple gift idea, from one gun-lover to another, has developed into an exciting business endeavor with uncapped potential. We’re launching this Kickstarter campaign to fund initial production and jump-start the business Sebastian Calvo, one of the co-founders said.

Sebastian “Seabass” Calvo served 7 years in the US Marine Corps as a Combat Engineer Officer, deploying to both Afghanistan and Iraq. He left the military in 2018 to pursue his Masters in Business Administration from New York University’s Stern School of Business.

Geraint “Gez” Jones served 12 years as an infantryman in the British Army. He is a combat veteran of Iraq and Afghanistan. Gez has written several of his own books and has co-authored with James Patterson. He is a New York and Sunday Times best selling author.

Our goal:

We’re aiming to reach a goal of $10,000 Geraint Jones said and we’re also looking for a $25,000 investment for 10% of the business. Since our founding, we have screened multiple manufacturing facilities and tested countless prototypes, and we have arrived at a quality we feel is worthy of stamp of approval as military veterans. We are now ready to start stocking inventory and fulfilling orders, and monetary support through investors or on our Kickstarter will help get that started.

HENSOLDT Introduces the New ZF 1-8×24 Telescopic Sight at Enforce Tac

Nuremberg, Germany, 5 March 2018 – At this year’s Enforce Tac trade fair in Nuremberg, HENSOLDT is presenting a new telescopic sight with a magnification of up to eight times. The ZF 1-8×24 offers an integrated red dot and a reticle that can each be separately illuminated.

Frank Topp, Head of Handheld Sight Systems at HENSOLDT, explains the background: “The ZF 1-8×24 offers the smallest variable magnification in the HENSOLDT portfolio. It was developed for short to medium ranges and is thus perfectly suited for the designated marksman and police forces.”

In this system, one-time magnification works like a red spot sight with a wide field of view. The shooter fires with both eyes open. In the ZF 1-8×24, the reticle is in the first image level, while the red spot is in the second image level and does not grow as the magnification is increased, so it does not conceal the target. “As soon as the shooter chooses a magnification from 1.3, the red spot is switched off and the reticle is illuminated. The illumination setting can be fixed at any desired position but the illumination does not increase,” added Topp. The new telescopic sight from HENSOLDT also offers a detent that can be locked at the null position for the elevation and lateral sight adjustment turrets.

Series production could begin as early as the third quarter of 2019.

Low-Profile Light Features Three Functions, Adjustable Eye-Safe IR Aiming Laser

EAGLEVILLE, PA, March 5, 2019 – Streamlight®, Inc., a leading provider of high-performance lighting and weapon light/laser sighting devices, introduced the TLR-VIR® II, a lightweight, compact rail-mounted tactical light with a high intensity white LED, an integrated infrared (IR) LED illuminator, and Class 1 “Eye Safe” IR aiming laser with windage and elevation adjustment controls. The new light securely fits all long guns with MIL-STD-1913 rails and M17/M18 pistols.

The TLR-VIR II enables users to easily toggle easily between bright light and the IR illuminator/laser. This feature allows military and law enforcement personnel to remain in a proper firing position when making the transition from IR mode to white light, and vice versa.  The light features a three-position mode rear selector switch, including IR illumination/IR laser, Safe Off (to prevent accidental turn-on), and visible illumination, that enables users to keep hands away from the muzzle during mode selection.

“The TLR-VIR II gives soldiers and first responders the ultimate in tactical lighting flexibility,” said Streamlight President Ray Sharrah. “With its high intensity white light and a long-running IR illuminator and Eye Safe IR laser for optimizing night vision, it’s an essential tool for those deploying with weapon lights.”

The new light, which is powered by a single CR123A lithium battery, uses the latest in LED technology for ultra-bright visible light, providing 5,000 candela, 300 lumens and a 1.5 hour run time.  For IR lighting, the TLR-VIR II uses an 850-nanometer LED emitter with 600mW/sr radiant intensity, providing optimum illumination when using night vision equipment; it delivers a run time of 12 hours. Its IR aiming laser has fully adjustable windage and elevation settings.

The TLR-VIR II has an ambidextrous momentary/steady on-off switch.  Like other TLR® models, the light has a rail clamp that can be easily attached and tightened with one hand, without the use of tools. The IR illumination/laser mode selection also features a tactile indicator on the light housing for switching modes with ease.

The TLR-VIR II is constructed from machined aircraft aluminum, with an anodized finish body and a high-impact, chemically resistant polymer black switch housing. The compact light weighs only 3.82 ounces and measures 3.30 inches long and 1.40 inches high. It uses a high temperature, shock-mounted, impact-resistant Borofloat glass lens. It is available in black and coyote.

Featuring extensively live-fire tested construction, the TLR-VIR II has an IPX7 rated design for waterproof operation to 1 meter for 30 minutes. It has an MSRP of $600.00.
