NSSF Praises Indiana Court Decision to End City of Gary Lawsuit
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, praises the unanimous decision by the Indiana Court of Appeals to end the City of Gary, Indiana’s 26-year-old frivolous lawsuit against firearm manufacturers that sought to hold them responsible for the criminal actions of unrelated and remote third parties. The Court upheld the constitutionality of a recently enacted law — championed by NSSF — providing that only the state of Indiana can bring a lawsuit against a firearm industry member. As a result, it directed the trial court to dismiss the lingering Smith & Wesson Corp. v. City of Gary public nuisance lawsuit, which failed to provide any evidence of wrongdoing despite more than a quarter century of litigation.
“This is a tremendous day for of the rule of law, common sense and the firearm industry,” said Lawrence G. Keane, NSSF Senior Vice President & General Counsel. “The City of Gary never had a serious claim. Instead, it was committed to a losing lawfare strategy to abuse the courts in order to force gun control policy outside of legislative channels. The bottom line is that these sorts of frivolous claims have no business clogging our courts and special-interest groups cannot circumvent elected representative bodies by attempting legislation through litigation. NSSF is deeply grateful to Indiana Attorney General Todd Rokita for his strong defense of this law.”
Former Indiana Gov. Eric Holcomb signed House Bill 1235 into law in 2024 that “provides that only the state of Indiana may bring or maintain an action by or on behalf of a political subdivision against a firearm or ammunition manufacturer, trade association, seller, or dealer concerning certain matters.” The law “prohibits a political subdivision from otherwise independently bringing or maintaining such an action,” effectively negating the City of Gary’s frivolous claims.
The City of Gary first filed their claims in 1999, as part of a coordinated effort by over 40 big city mayors who conspired together through the U.S. Conference of Mayors with gun control activist from Brady United (formerly known as the Brady Center) trial lawyers.
All these municipal lawsuits have either been dismissed by the courts, e.g., Atlanta, Chicago, New York, Los Angeles, San Francisco, Detroit and St. Louis, or simply dropped by several cities, e.g., Boston, Cincinnati, Wilmington and Camden. Many of these municipal lawsuits were dismissed based on state preemption laws enacted between 1999 to 2001 upon which H.B. 1235 is modeled. Like H.B. 1235, these laws — that have been upheld by the courts — reserve to the state the exclusive authority to sue members of the industry except that they generally allow for breach of warranty and related claims for firearms a political subdivision purchased.
Additionally, Congress passed in a broad bipartisan fashion, and President George W. Bush signed into law, the Protection of Lawful Commerce in Arms Act (PLCAA) in 2005. The PLCAA blocks lawsuits that attempt to hold firearm and ammunition industry companies liable for the criminal actions of third parties who misuse the industry’s lawful non-defective products. More specifically, this commonsense law ensures that responsible and law-abiding federally licensed manufacturers and retailers of firearms and ammunition are not unjustly blamed in federal and state civil actions for “the harm caused by those who criminally or unlawfully misuse” these products that function as designed and intended.

Maintaining communication in remote or obstructed terrain remains a persistent challenge for border and special-operations units. Steep valleys, dense forests, and rugged highlands often weaken or scatter radio signals, making it difficult for teams to coordinate or request support. Conventional radios can work over long distances, but the antennas required for reliable coverage are typically bulky, limiting their use in fast-moving or dismounted missions.
A new prototype radio using quantum-based reception methods aims to address these constraints. The device, weighing roughly 3 kilograms, was recently evaluated during field exercises and successfully received transmissions from dozens of kms away. According to engineers involved in the trials, operators were able to decode information in real-time despite difficult terrain that usually disrupts traditional communications.
While the system is still in early testing, it reflects a growing effort to introduce lightweight, infrastructure-independent communications tools for defense and homeland-security missions. Forces operating along long, sparsely populated borders or in disaster-struck regions often lack reliable connectivity; a compact radio that maintains range without relying on tall antennas or fixed repeaters could reduce operational blind spots and provide a dependable backup during emergencies.
According to Interesting Engineering, the core innovation lies in the radio’s miniaturised receiving mechanism. Engineers redesigned the antenna array using principles from quantum sensing, shrinking the hardware to only a few centimetres while maintaining the sensitivity required for long-distance reception. By reducing the footprint of the receiving system, the prototype becomes practical for individual soldiers to carry without compromising mobility.
Initial tests took place in the Saibei grasslands north of the Great Wall, where the terrain and sparse infrastructure provided a realistic evaluation environment. Additional trials are planned along coastal regions to assess how the system performs in environments with variable atmospheric and electromagnetic conditions.
Beyond the prototype itself, the project illustrates a broader trend: quantum communication, detection, and computing technologies are beginning to leave research facilities and undergo evaluation by operational units. Several global defense programs now view quantum systems as a potential advantage for secure communications, advanced sensing, and resilient command-and-control in contested settings.
As competition intensifies around next-generation military technologies, the development of portable, quantum-enabled radios highlights how quickly niche scientific concepts are being adapted for practical use in the field.

Certification Streamlines Procurement for U.S. Government Buyers and Confirms FANG as a Fully Vetted, NDAA-Compliant FPV System
SAN JUAN, Puerto Rico, Oct. 30, 2025 (GLOBE NEWSWIRE) — Red Cat Holdings, Inc. (Nasdaq: RCAT) (“Red Cat” or the “Company”), a U.S.-based provider of advanced all-domain drone and robotic solutions for defense and national security, today announced that its FANG™ FPV drone system has been officially added to the Department of War’s Blue UAS Cleared List.
This designation affirms that the complete FANG system, previously pending inclusion, meets the Pentagon’s highest standards for cybersecurity, supply chain integrity, and operational trustworthiness. With full certification, the system is now eligible for streamlined acquisition by the Department of War and other federal agencies, with no need for additional cybersecurity approvals or sourcing waivers.

A New Era for FPV Drones
Blue UAS certification confirms that FANG meets the Department of War’s highest standards for cybersecurity, supply chain integrity, and operational trustworthiness. It ensures full NDAA Section 848 compliance and allows the DoW and other agencies to acquire the system without waivers or additional approvals.
Working through a U.S. military lab, Red Cat secured one of the first FPV components accepted into the Blue UAS Framework through partner UMAC. With four UMAC components integrated, the full FANG system is now certified and listed, giving users a compliant, government-cleared platform available as a complete system or modular DIY kit.

The FANG F7 is available for direct purchase or through approved government procurement channels. Additional models in the FANG line are under development and will build on this foundation with extended capabilities while maintaining full compliance with DoW procurement requirements.
