NSSF Challenges California’s Law Encouraging Frivolous Firearm Industry Lawsuits

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, filed a challenge to California’s unconstitutional firearm industry liability law, AB 1594, that was passed last year and signed into law by Gov. Gavin Newsom. The law encourages civil suits against the firearm industry for the damages caused by the criminal actions of remote third parties. This law is an affront to the U.S. Constitution and abuses the judicial system in an attempt to circumvent the will of the U.S. Congress when it passed the Protection of Lawful Commerce in Arms Act (PLCAA). The law goes into effect July 23.

NSSF filed NSSF v. Bonta in the U.S. District Court for the Southern District of California. NSSF will seek a preliminary injunction to halt enforcement of the unconstitutional law as the challenge progresses through the courts.

“California’s General Assembly and Governor Newsom made a spectacle of defying the U.S. Supreme Court’s Bruen decision when this bill was passed and enacted,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “This law is openly hostile to the firearm industry and also defiant to Congress, the U.S. Supreme Court and the Constitution. Governor Newsom’s angst toward the foundations of America’s freedoms exceeds the borders of his state and his law attempts to exert California’s radical gun control agenda across the United States. NSSF will defend our Constitutionally-protected industry against the broadsides of this extremist agenda.”

NSSF’s challenge explains that AB 1594, misleadingly titled the “Firearm Industry Responsibility Act,” is a law that was drafted prior to the Bruen decision and signed just weeks after the Supreme Court published the landmark ruling. Rather than re-examining the legislation to ensure it complied with Supreme Court precedent, Gov. Newsom forged ahead, challenging the ruling when he signed it.

The law bans the manufacture, sale and marketing of firearms the state deems “abnormally dangerous” regardless if they are commonly-owned. It also encourages civil lawsuits by a person who has suffered harm in California, the Attorney General, or city or county attorneys against a firearm industry member for the harm caused by the criminal misuse of a firearm by a remote third party. This is expressly prohibited by PLCAA. The law unconstitutionally invades the sovereignty of sister states by directly regulating lawful commerce occurring entirely and wholly outside the state of California in violation of the Commerce Clause and our system of federalism.

Further, the law not only infringes on Second Amendment rights but chills First Amendment rights by restricting protected free-speech advertising of Constitutionally-protected products that are lawfully made and sold – even when that advertising takes place outside of California’s borders.

California’s AB 1594 is clearly unconstitutional on several fronts. The law is an affront to the U.S. Constitution and rights that belong to the People. It is nothing less than an unlawful attempt to abuse the courts to achieve “legislation through litigation.”

Fort Gregg-Adams (Lee) Next on U.S. Patriot Bravery Tour

XS Sights Introduces R3D Night Sights for Kimber K6s Revolver

Fort Worth, Texas (May 22, 2023) – XS Sights is pleased to introduce R3D Nights Sights for the Kimber K6s^™. Owners of this compact, stainless-steel revolver who have trouble seeing their factory sights or simply wish to upgrade for better front sight visibility, day or night, now have the option of this highly effective 3-dot tritium notch and post sight.

The R3D front sight is equipped with XS’s proprietary Glow Dot with tritium center for dual illumination. The Glow Dot absorbs ambient light and glows in low light while also absorbing light from the tritium which continually charges the dot. This makes the front sight glow even brighter than the tritium rear sights which drives focus toward the front sight and downrange threat, enabling faster and more accurate target acquisition.

SOF Week 2024 exhibit spaces

Although we’re still closing out SOF Week 2023, we are already starting to plan for SOF Week 2024. Many people have asked to book exhibit space for 2024, but I want to explain why we are not able to start those sales immediately and share our way ahead.
As you know, this was GSOF’s first year executing SOF Week. Additionally, we did so on a truncated timeline, and due to that, a lot of the concepts we outlined in our proposal were not implemented to their full extent. We intend to improve and expand for 2024.
GSOF and USSOCOM will use the next 45 – 60 days to conduct a thorough review of this year’s event in order to assess what went well and what needs improvement. There are also three big changes in 2024: (1) the Tampa Convention Center will open 40,000 square feet of additional meeting space; (2) we have the ability to reserve more meeting space in the JW Marriott; and (3) the 2024 conference will be an “international” year in which USSOCOM invites partner nations to attend. We want to ensure that we take all of this into consideration before selling exhibit space or sponsorships for next year.
We anticipate having the final approvals for the format and layout of SOF Week 2024 by the end of July, and we think we will be able to open sales to GSOF Corporate Partners by the end of August. Sales to non-GSOF Corporate Partners will open in September, but we do not yet know the process by which exhibitors and sponsors will be selected. This is part of the review process underway right now. In keeping with the GSOF mission statement, GSOF is committed to ensuring exhibitors are representative of companies supporting USSOCOM’s Title X responsibility, “to develop, acquire, field, and sustain technology in support of USSOCOM mission objectives”.
The reality is that the SOF Week Campus is not large enough to accommodate every company that wishes to exhibit. GSOF will do its best to ensure the exhibition is robust, engaging, and impactful. Moreover, we aim to deliver high-quality content that meets the USSOCOM Commander’s objectives for the conference.
GSOF will hold virtual focus groups to gather feedback on SOF Week 2023 at the end of May. We’d love to hear from you.

SEAGUARDIAN® USED BY USN IN SUPPORT OF INTEGRATED BATTLE PROBLEM

Series of ASW and MUM-T Exercises Showcase Advantages of UAS

SAN DIEGO – 18 May 2023 – In support of the U.S. Navy’s (USN) Integrated Battle Problem 2023 (IBP-23) exercise in May, General Atomics Aeronautical Systems, Inc. (GA-ASI) conducted a series of Anti-Submarine Warfare (ASW) exercises cooperatively with the USN Helicopter Maritime Strike Squadrons (HSM) 38, 49, 71, and 75. GA-ASI flew a company-owned MQ-9B SeaGuardian® Unmanned Aircraft System (UAS) under a USN Flight Clearance. The HSM squadrons flew the MH-60R Seahawk helicopter flown out of Naval Air Station North Island off the coast of San Diego, Calif., on April 24-25, 2023.

The exercise was focused on Manned-Unmanned Teaming (MUM-T) to conduct Cooperative ASW in the Southern California Offshore ASW range. During the two-day event, MH-60s dropped sonobuoys to detect a mobile training target. Using the combined SeaGuardian and MH-60R teaming concept, correlation and location of the target was expeditiously achieved and tactical reports – known as TACREPs – were then transmitted to Commander, Task Force (CTF) 34 Theater ASW Center at Naval Station Pearl Harbor via the MQ-9B crew. The CTF then directed a coordinated constructive “kill” of the simulated submarine with notional torpedoes dropped from the MH-60s. The ASW payload on the SeaGuardian uses the latest version of General Dynamics Mission Systems’ Sonobuoy Processor.

“These advanced tactics, techniques, and procedures utilizing MUM-T further reinforce the advantages to unmanned aircraft in combat with less risk to force,” said GA-ASI Vice President of DoD Strategic Development Patrick Shortsleeve.

The IBP-23 exercise is the third time GA-ASI’s MQ-9B SeaGuardian has supported this annual event. These exercises generate warfighting advantages for the Fleet by providing the operational environment to work through tactics, techniques, procedures, and command and control to refine and enhance warfighting. The Fleet IBP series is led by Commander, U.S. Pacific Fleet and executed by Commander, U.S. 3rd Fleet and will continue throughout May 2023.

“Another discovery from the survey is that professionals are ready to grow through skill building and training,” she said. “Fifty-one percent of survey participants expressed eagerness to improve skills via professional development education, while thirty-one percent hunger for firsthand training from leadership,” said Keiner. “Those numbers reflect a tangible opportunity to engage workers and guide company culture through education and mentoring.”
