Firearm Manufacturer Defendants File Motion for Judgement on the Pleadings in City of Gary Lawsuit
WASHINGTON, D.C. — Defendants in the City of Gary public nuisance lawsuits are moving to end nearly quarter of a century of legal maneuverings after Indiana Gov. Eric Holcomb signed HB 1235 into law last week. Today the defendants filed a joint motion for judgement on the pleadings with the court. Indiana’s law that reserves the right to seek legal action against the firearm industry to state authorities, instead of municipalities, went into immediate effect when it was signed March 15.
“The time has come to end this legal charade. The City of Gary has had nearly 25 years to present a case for their frivolous claims and hasn’t been able to do so. That’s because there was no substance to their outlandish claims,” said Lawrence G. Keane, NSSF Senior Vice President & General Counsel. “Indiana’s new law allows the firearm industry, the state of Indiana and the City of Gary, to end this legal fishing expedition. The defendants in this case are ready to move on and resign this case to the same category as the many others like it from that era over two decades ago. This case is, and always was, frivolous, an abuse of the legal system and a losing strategy to bypass state and federal legislatures to implement special-interest gun control policy through the courts instead of through the elected bodies that represent the will of the people.”
The City of Gary, Ind., first filed their claims in 1999, as part of a coordinated effort by 40 big city mayors who conspired together through the U.S. Conference of Mayors with lawyers from the gun control group Brady United (formerly known as the Brady Center), and trial lawyers.
All these municipal lawsuits have either been dismissed by the courts, e.g., Atlanta, Chicago, New York, Los Angeles, San Fransico, Detroit and St. Louis, or simply dropped by several cities, e.g., Boston, Cincinnati and Camden. Many of these municipal lawsuits were dismissed based on state preemption laws enacted between 1999 to 2001 and upon which H.B. 1235 is modeled. Like H.B. 1235, these laws – that have been upheld by the courts – reserve to the state the exclusive authority to sue members of the industry except that they allow for breach of warranty and related claims for firearms a political subdivision purchased.
Additionally, Congress passed in a broad bipartisan fashion, and President George W. Bush signed into law, the Protection of Lawful Commerce in Arms Act (PLCAA) in 2005. The PLCAA blocks lawsuits that attempt to hold firearm and ammunition industry companies liable for the criminal actions of third parties who misuse the industry’s lawful non-defective products. More specifically, this common-sense law ensures that responsible and law-abiding federally licensed manufacturers and retailers of firearms and ammunition are not unjustly blamed in federal and state civil actions for “the harm caused by those who criminally or unlawfully misuse” these products that function as designed and intended.

Indiana, Utah Governors Sign Second Amendment Privacy Laws
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, applauds Indiana Gov. Eric Holcomb and Utah Gov. Spencer Cox for signing the NSSF-supported Second Amendment Privacy Acts in their respective states. The laws will bar the use of a firearm-retailer specific Merchant Category Code (MCC) for banks, credit card companies or financial service providers to track the lawful sale of firearms and ammunition.
Both governors signed their laws, Indiana’s HB 1084 and Utah’s HB 406, in their respective states last week. NSSF worked closely with legislators in those states to bring legislation to protect private and legal purchases from exploitation. The laws are designed to protect the privacy of lawful and private firearm and ammunition purchases from being abused for political purposes by corporate financial service providers and unlawful government search and seizure of legal and private financial transactions.
“Corporate banks and the federal government have already proven they will run roughshod over Second Amendment and Privacy rights. The need to safeguard private and legal purchases of firearms and ammunition by law-abiding citizens has never been greater,” said Lawrence G. Keane, NSSF Senior Vice President & General Counsel. “NSSF thanks both Governor Holcomb and Governor Cox for their leadership in signing these laws that will protect the rights of the citizens in their states. No American should fear being placed on a government watchlist simply for exercising their Constitutionally-protected rights to keep and bear arms.”
The U.S. Treasury’s Financial Crimes Enforcement Network (FinCEN) admitted to U.S. Sen. Tim Scott (R-S.C.) in a letter that it violated the Fourth Amendment rights of law-abiding citizens that protect against illegal search and seizure when it collected the credit card purchase history from banks and credit card companies of individuals who purchased firearms and ammunition in the days surrounding Jan. 6, 2020. Treasury’s FinCEN had no cause, and sought the information without a warrant, to place these law-abiding citizens on a government watchlist only because they exercised their Second Amendment rights to lawfully purchase firearms and ammunition.
The idea of a firearm-retailer specific MCC was borne from antigun New York Times columnist Andrew Ross Sorkin and Amalgamated Bank, which has been called “The Left’s Private Banker” and bankrolls the Democratic National Committee and several antigun politicians. Amalgamated Bank lobbied the Swiss-based International Organization for Standardization (ISO) for the code’s creation. NSSF has called on Congress to investigate Amalgamated Bank’s role in manipulating the ISO standard setting process.
Sorkin admitted creating a firearm-retailer specific MCC would be a first step to creating a national firearm registry, which is forbidden by federal law.
Indiana and Utah join Florida, Idaho, Mississippi, Montana, North Dakota, Texas and West Virginia with laws protecting citizens’ Second Amendment privacy. Several other states are considering similar legislation. U.S. Rep. Elise Stefanik (R-N.Y.) introduced H.R. 7450, the NSSF-supported Protecting Privacy in Purchases Act, in the U.S. House of Representatives. California’s Gov. Gavin Newsom signed a law requiring the use of a firearm-retailer specific MCC and Colorado is considering similar legislation.

FAA Ends Discretionary Enforcement Policy on Drone Remote Identification
WASHINGTON– Pilots who operate drones that are required to be registered must comply with the Remote ID Rule.
In September 2023, the FAA issued a policy for exercising discretion in determining whether to take enforcement action for drone operators who were not able to comply with the Remote ID rule. That policy ends on March 16, 2024. Operators who do not comply after that date could face fines and suspension or revocation of their drone pilot certificates.
Congress directed the FAA to develop standards for remotely identifying operators and owners of drones and issue regulations or guidance based on those standards.
Remote ID lays the foundation of the safety and security groundwork needed for more complex drone operations. It acts like a digital license plate and will help the FAA, law enforcement and other federal agencies locate the control station when a drone appears to be flying in an unsafe manner or where it isn’t allowed to fly.]

NSSF Praises Indiana Governor Signing Law to End City of Gary Lawsuit
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, praises Indiana Gov. Eric Holcomb’s signing of House Bill 1235, legislation that “provides that only the state of Indiana may bring or maintain an action by or on behalf of a political subdivision against a firearm or ammunition manufacturer, trade association, seller, or dealer concerning certain matters.” The bill “prohibits a political subdivision from otherwise independently bringing or maintaining such an action.”
The industry members the City of Gary sued are expected to promptly file a motion to dismiss the case based on this new law that became effective immediately upon the Governor’s signature. Lawyers representing the city acknowledged in their testimony opposing the bill that if it were to be enacted it would mean the City of Gary’s lawsuit will be dismissed. The City of Gary’s nearly quarter-century old frivolous lawsuit against firearm manufacturers seeks to hold them responsible for the criminal actions of unrelated and remote third parties.
“This is a tremendous victory for common sense. The City of Gary never had a serious claim. Instead, it was committed to a losing strategy of lawfare to abuse the courts in order to force through gun control policy outside of legislative channels,” said Lawrence G. Keane, NSSF Senior Vice President & General Counsel. “NSSF is grateful for Indiana Rep. Chris Jeter for his leadership when he introduced this legislation, the Indiana legislature including Sen. Aaron Freeman for its commitment to the law and Governor Holcomb for his faithfulness to the principles of ensuring politically-motivated lawsuits don’t clog our courts and allow special-interests to circumvent the legislative authority reserved by the State of Indiana.”

Nighthawk Custom is proud to present the Wall Street pistol, a 1-of-1 pistol that has been masterfully built and hand engraved. Crafted with meticulous detail, it bears the chronicles of finance, power; and the ebb and flow of history etched in steel.
The right side of the gun serves as a visual homage to the roots of Wall Street in America. At the rear of the slide, a depiction of the slave market capturing the likeness of Petrus Stuyvesant, the governor of the Netherlands, inaugurated in 1647. The date 1647 has been inlayed with gold. The barrel hood features the embankment wall with a protective fence, a barrier against English soldiers, and below it, the emblem of the Dutch West India Company.
Just in front of the ejection port, Stuyvesant, with his wooden leg, marches with his troops in front of what would later become the Federal Hall. This iconic location witnessed the passage of the “Bill of Rights” in the first Congress, immortalized in solid 24-carat gold.
The left side of the pistol begins with the Trinity Church which stands across from Wall Street. The words “Wall Street” gleamed in gold, and beside it, the Charging Bull, the iconic symbol of Wall Street, stands tall in 24-carat. The stock exchange with two traders and the fluctuating share prices are meticulously engraved, capturing the essence of financial fervor.
At the rear of the slide, the pistol reveals a front view of modern Wall Street, where towering skyscrapers kiss the sky. The entrance to the building are inlaid in solid silver, a testament to the evolution of the financial district over the years.
The Wall Street pistol’s grips and trigger are crafted from shredded $100 bills, sourced from the Bureau of Engraving and Printing. This unique touch makes a tangible connection between the firearm and the very fabric of American currency.
The custom case for the Wall Street pistol has been constructed out of matchbooked Myrtle Wood Burl. All of the exterior voids in the wood have been filled with currency and both sides of the case have been carved to resemble the New York Stock Exchange building.
The interior of the case has been fully embedded with retired US currency. In total, $92 worth of currency was used on the box, with the year 1792 being an important year for Wall Street. This was when the Buttonwood Agreement was signed on May 17, 1792, it sets rules for how stocks could be traded and established set commissions.
The Wall Street pistol is more than just a pistol, it is an historical artifact, a 1-of-1, a tangible embodiment of the financial district’s journey through time.

EAST ALTON, IL (March 14, 2024) — Team Winchester came out in full force at the recent NSCA Western Regional in Phoenix, Arizona, taking five of the top six scores in the main event. Anthony Matarese secured the top score overall in the main event with Team Winchester members, Zach Kienbaum and Theo Ribbs taking second and third place.
The Matarese, Kienbaum, Ribbs trio all shot the AA Super Handicap, 1 1/8 oz, 1,250 fps target load in the main event, one of the most popular rounds among competitive sport shooters.
With several other runner-up and third-place finishes in various events, it is safe to say Team Winchester is a force to be reckoned with in the 2024 NSCA Championship Tour, Powered by Winchester.

NSSF Applauds Missouri Resolution Supporting Commercial Utilization of Lake City Army Ammunition Plant
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, applauds Missouri state Rep. Aaron McMullen’s introduction of a concurrent resolution supporting the continued commercial utilization of Lake City Army Ammunition Plant. The resolution would mark the Missouri General Assembly’s support for the commercial utilization and urges the U.S. government to reject calls to end to program that allows the Lake City ammunition facility to remain fully staffed and able to operate at a sustained peak capacity to meet the ammunition needs of the U.S. warfighter.
“Lake City Army Ammunition Plant is undeniably a critical asset to our nation’s military readiness. The capability to supply our nation’s warfighters with the essential ammunition is made possible because commercial utilization invests in the skilled personnel and equipment, maintenance and training,” said Lawrence G. Keane, NSSF Senior Vice President & General Counsel. “Calls by certain politicians to end this program are incredibly short-sighted and dangerous. NSSF is grateful to Representative Aaron McMullen for his leadership to protect the critical role Lake City Army Ammunition Plant fulfills in our national defense.”
The U.S. Army began permitting commercial utilization over 20 years ago after officials realized during the ramp up to the wars in Iraq and Afghanistan that the facility did not have the trained workforce and production capacity to meet the military’s surge in demand for ammunition to support the U.S. warfighter. The Department of Defense (DoD) was forced to buy ammunition from foreign countries. The U.S. Army wisely adopted commercial utilization to ensure military readiness.
House Concurrent Resolution 62 notes that Missouri’s Constitution recognizes the pre-existing right of the people to keep and bear arms, which necessarily includes ammunition. It also notes that public officials who swear an oath to support the Constitution are inappropriate in remarks that seek to end the supply of ammunition to law-abiding citizens. The resolution details the critical role of Lake City Army Ammunition Plant in national defense and how commercial utilization of the plant that has ensured peak readiness and sustainability of ammunition production has been achieved since 2001.
Lake City Army Ammunition Plant employs over 700 good-paying union jobs, which would be put at risk if commercial utilization were to end. Commercial utilization of ammunition production enables investments in trained and skilled workers and replacement and maintenance of necessary equipment that ensures a steady supply of ammunition to the U.S. Armed Forces and America’s allies.
