NSSF Applauds N.H. Gov. Sununu for Signing Firearm Purchaser’s Privacy Act

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, applauds New Hampshire Gov. Chris Sununu for signing H.B. 1186, the Firearm Purchaser’s Privacy Act, into law last week. This NSSF-supported law protects the privacy and sensitive financial information of people purchasing firearms and ammunition in The Granite State. With New Hampshire, there are now 17 states with laws that protect the Second Amendment financial privacy of their citizens.

The law prohibits financial institutions from requiring the use of a firearm code, also known as a Merchant Category Code (MCC), from being assigned to firearm and ammunition purchases at retail when using a credit card. Additionally, the law gives enforcement authority to the state attorney general for any business entity found in violation of the law.

“Governor Chris Sununu’s signing of the Firearm Purchaser’s Privacy Act is a necessary tool to protect the Second Amendment and privacy rights of New Hampshire citizens from unlawful intrusion on their private purchases when purchasing firearms and ammunition with a payment card,” said Jake McGuigan, NSSF’s Government Relations – State Affairs Managing Director. “Law-abiding gun purchasers in the ‘Live Free or Die’ state won’t need to worry that ‘woke’ Wall Street banks, credit card companies and payment processors will collude with government entities to spy on their private finances for exercising their rights. No American should fear being placed on a government watchlist simply for exercising their Constitutionally-protected rights to keep and bear arms.”

NSSF worked closely with New Hampshire legislators to protect private and legal firearm and ammunition purchases from political exploitation. The Firearm Purchaser’s Privacy Act is designed to protect the privacy of lawful and private firearm and ammunition purchases from being abused for political purposes by corporate financial service providers and unlawful government search and seizure of legal and private financial transactions.

The U.S. Treasury’s Financial Crimes Enforcement Network (FinCEN) admitted to U.S. Sen. Tim Scott (R-S.C.) in a letter that it violated the Fourth Amendment rights of law-abiding citizens that protect against illegal search and seizure when it collected the credit card purchase history from banks and credit card companies of individuals who purchased firearms and ammunition in the days surrounding Jan. 6, 2020. Treasury’s FinCEN had no probable cause, and sought the information without a warrant, to place these law-abiding citizens on a government watchlist only because they exercised their Second Amendment rights to lawfully purchase firearms and ammunition.

The idea of a firearm-retailer specific MCC was borne from antigun New York Times’ columnist Andrew Ross Sorkin and Amalgamated Bank, which has been called “The Left’s Private Banker” and bankrolls the Democratic National Committee and several antigun politicians. Amalgamated Bank lobbied the Swiss-based International Organization for Standardization (ISO) for the code’s creation. NSSF has called on Congress to investigate Amalgamated Bank’s role in manipulating the ISO standard setting process for political purposes.

Sorkin admitted creating a firearm-retailer specific MCC would be a first step to creating a national firearm registry, which is forbidden by federal law.

New Hampshire joins a growing list of states that are standing against the invasion of financial privacy when exercising Second Amendment rights, including Louisiana, Alabama, Georgia, Tennessee, Iowa, Kentucky, Wyoming, Indiana, Utah, Florida, Idaho, Mississippi, Montana, North Dakota, Texas and West Virginia. These states passed laws protecting citizens’ Second Amendment privacy. Other states are considering similar legislation. U.S. Sen. Bill Hagerty (R-Tenn.) introduced S. 4075, the NSSF-supported Protecting Privacy in Purchases Act in the Senate. U.S. Rep. Elise Stefanik (R-N.Y.) introduced H.R. 7450, with the same title in the U.S. House of Representatives. Three states – California, Colorado and New York– have passed legislation requiring payment card processors to report purchases by a firearm retailer-specific MCC.

NSSF Rebukes Massachusetts Legislation Denigrating Second Amendment Rights to State Privilege

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, rebukes legislation proposed by Massachusetts House and Senate lawmakers that would denigrate the Second Amendment to a state-granted privilege and do nothing to hold criminals accountable for the criminal misuse of firearms.

State lawmakers negotiated a compromise through a closed-door conference committee and no input from the firearm industry, releasing the bill with just two weeks left in the session. However, this bill is anything but a compromise. It runs roughshod over the fundamental rights to keep and bear arms by creating unconstitutional age-based gun bans, magazine bans and subjects lawful firearm owners to onerous licensing requirements and searchable databases that compromise privacy.

“After nearly a year, in the state where the American Revolution began, Massachusetts legislators are seeking to rush through a 111-page bill that will do nothing to stem violence in the Commonwealth and will only create a bloated bureaucratic mess that impacts law-abiding gun-owners,” said Jake McGuigan, NSSF’s Government Relations – State Affairs Managing Director. “The legislature had the opportunity to do something truly special with a strong bill to address violence. Instead, the bill aims to suppress the exercise of the Second Amendment by implementing onerous training requirements just to purchase a firearm, bans all of the most commonly-used guns in America and implements a draconian gun registration scheme that criminals will ignore. It even makes it illegal for a 15-year-old Boy Scout to use a .22 caliber rifle to earn a merit badge. Judges continue to set free criminals in the Commonwealth while the legislature makes law abiding citizens immediate felons.”

The negotiated legislation now includes, among other restrictions:

Full registration of ALL guns.
Onerous licensing and administrative requirements on retailers. For example, all guns in inventory need to be registered with the state before they are even sold.
Bans all legally-owned magazines with a capacity greater than 10 rounds. Those standard-capacity magazines already lawfully owned would be barred from transfer.
State police would create a roster of banned semi-automatic rifles and database of all guns.
Commissions to study “technologies” like microstamping that has already been proven by independent peer review research to be flawed and unreliable.
Live-fire requirement despite the fact there are very few public ranges where this can be done.
Publicly searchable in database of all lawful firearm owners.
Creates another government database to issue serial numbers for all firearms.
Small, independent retailers will be saddled with inventory they can no longer sell.

Failure to register a firearm could be punished by a fine of up to $1,000 for a first offense; (ii) by a fine of up to $7,500 or imprisonment up to six months, or by both, for a second offense; or (iii) by a fine of up to $10,000 or imprisonment for between one and five years, or by both, for a third or subsequent offense.

Massachusetts lawmakers introduced this legislation in reaction the U.S. Supreme Court’s Bruen decision, that affirmed the Second Amendment is an individual right and governments cannot infringe on the ability to exercise that right in public. Supreme Court Justice Clarence Thomas wrote in the majority opinion, “The constitutional right to bear arms in public for self-defense is not a second-class right, subject to an entirely different body of rules than the other Bill of Rights guarantees. We know of no other constitutional right that an individual may exercise only after demonstrating to government officers some special need.”

This proposed legislation by Massachusetts lawmakers is clearly unconstitutional as it would deny the Constitutionally-protected rights to keep and bear arms to adults under 21, who are fully-vested in the entire spectrum of their rights. This legislation is not compromise. It is a frontal attack on the liberties and rights belonging to law-abiding citizens of Massachusetts.

EAST ALTON, IL (July 17, 2024) — The first Kids & Clays shooting sports event to benefit families in need launched in 1999 with the support of Winchester Ammunition and has grown to be a major fundraiser for participating Ronald McDonald House Charities (RMHC) chapters across the country. To date, more than $36,000,000 has been raised by good people who enjoy the shooting sports and have a heart for children and their families—it is a news story that hasn’t been trumpeted loudly enough.
“Our long-standing commitment—25 years—as a major ammunition supporter to Kids & Clays is extremely important,” said Brett Flaugher, president of Winchester Ammunition. “We are proud that our brand of more than 150-years is associated with organizations like Kids & Clays and that we can help further their mission.”
In 1999, Glenn and Kathy Lubeznik, McDonald’s owner/operators in Northwest Indiana, chaired the first annual Sporting Clays Tournament Event benefitting the Chicago Ronald McDonald House®. With the support of Winchester Ammunition, McDonald’s Owner/Operators and McDonald’s Suppliers, the event hosted 137 participants and generated more than $15,000 for the House.
The next year, companies and organizations such as Browning, the National Shooting Sports Foundation (NSSF) and the National Sporting Clays Association (NSCA) followed Winchester’s lead and agreed to support the event as sponsors. More than 220 participants shot in the Chicago tournament and the Chicago Ronald McDonald House was again the beneficiary, to the tune of over $58,000
The rapid success of the Chicago area tournament inspired Mr. Lubeznik to share his knowledge of this fundraiser with Ronald McDonald Houses across the country. Because of the potential for growth of this program, Mr. Lubeznik formed what is known today as the Kids & Clays Foundation. The Foundation’s goal was to promote shooting tournaments as a unique type of fundraising event for Ronald McDonald Houses across the nation.
Each year, Winchester donates thousands of dollars of ammunition and merchandise to support nearly 50 Kids & Clays events. The local RMHC’s keep 100 percent of the net proceeds from each event. What started as tens of thousands of dollars annually in fundraising has grown exponentially with 2023 setting a record high of nearly $3.6 million all to help critically ill children from coast to coast.

SAAMI Ballistics Conference Special Hotel Rate Deadline is Aug. 19

SHELTON, Conn — The Sporting Arms and Ammunition Manufacturers’ Institute®, Inc., (SAAMI®), has scheduled its 2024 Ballistics Conference for September 10-12 in Salt Lake City, with Utah Governor Spencer Cox slated to give the keynote address.

SAAMI reminds attendees not to miss the August 19 deadline to save money by taking advantage of the special room rate at the host Sheraton Salt Lake City hotel. The conference will feature full-day presentations on September 10 and 11 and live demonstrations at a shooting range on September 12.
