NSSF Praises SCOTUS Decision to Review Mexico’s Baseless $10 Billion Lawsuit Against Firearm Manufacturers
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, praised the U.S. Supreme Court’s decision to grant Smith & Wesson’s petition to hear Estados Unidos Mexicanos v. Smith & Wesson Brands, Inc., et al., Mexico’s frivolous $10 billion lawsuit against American firearm manufacturers seeking to blame them for the harm caused by lawless narco-terrorist drug cartels in Mexico. Mexico’s lawsuit also seeks to dictate how firearms are made and sold throughout the United States through a federal court injunction, in effect usurping the role of Congress and 50 state legislatures. NSSF filed an amicus brief earlier this year in support of the Supreme Court granting the case, arguing that the U.S. Court of Appeals for the First Circuit’s flawed decision, “blows a gaping hole in the PLCAA and rolls out the red carpet for a foreign government intent on vitiating the Second Amendment.” The U.S. Supreme Court will now set a briefing schedule and hold argument, likely early in the new year.
“Today’s announcement by the U.S. Supreme Court that they are granting Smith & Wesson’s petition to hear Mexico’s frivolous $10 billion lawsuit against lawful American firearm manufacturers is welcomed news to the entire firearm industry. Mexico’s lawsuit seeks to blame lawful American firearm businesses for violence in Mexico perpetrated by Mexican narco-terrorist drug cartels and impacting innocent Mexican lives. It is not the fault of American firearm businesses that follow strict laws and regulations to lawfully manufacture and sell legal products,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “This case represents exactly why Congress passed, and President George W. Bush enacted, the bipartisan Protection of Lawful Commerce in Arms Act (PLCAA). The case was rightly dismissed by a federal judge before the First Circuit Court of Appeals’ erroneous ruling earlier this year that reversed the district court order and reinstated the case. Lawful American firearm manufacturers follow American laws to make and sell lawful and Constitutionally-protected products. The Mexican government should instead focus on bringing Mexican criminals to justice in Mexican courtrooms.”
Mexico alleges U.S. firearm manufacturers are liable for the criminal violence perpetuated by narco-terrorist drug cartels by refusing to adopt gun control restrictions that exceed what the law requires for the strictly-regulated production and sale of firearms. A U.S. District court in Massachusetts dismissed the case, finding the claims were barred by the PLCAA. The U.S. Court of Appeals for the First Circuit, however, revived the case on Mexico’s appeal earlier this year. The First Circuit held that Mexico’s claims alleging that the defendants know their regular business practices contribute to illegal firearm trafficking fit within a narrow exception to the PLCAA. Smith & Wesson Brands, Inc., et al, the petitioners, argue the First Circuit erred when it reversed the lower court’s decision to dismiss the case. The petitioners also noted the First Circuit’s decision to allow for an exception to PLCAA fails because there is no evidence U.S. firearm manufacturers violated federal laws against aiding and abetting firearm trafficking. The petitioners explained to the Supreme Court that Mexico’s complaint “fails to identify any product, policy, or action by the American firearms industry that is deliberately designed to facilitate the unlawful activities of Mexican drug cartels.”
NSSF’s amicus brief concluded by urging Supreme Court action and pointing out that the First Circuit’s decision to reinstate the case was incorrect because it is “… emblematic of a recent trend of anti-gun governments (and courts) mendaciously skirting the PLCAA and using the resulting threat of bankruptcy-inducing tort liability to destroy a lawful industry that is vital to the exercise of a fundamental constitutional right. This Court’s intervention is imperative.”

NSSF Supports U.S. House Oversight Investigation of Biden-Harris, Gun Control Collusion to Target Firearm Manufacturer
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, wholeheartedly supports the U.S. House of Representatives Oversight Committee’s subpoena of The White House Office of Gun Violence Prevention to investigate allegations that the administration wrongfully colluded with gun control groups and the City of Chicago to bring an unfounded lawsuit against a firearm manufacturer. It is proper and fitting that the House of Representatives exercises its oversight authority to demand records of the office led by Vice President Kamala Harris, which appears to have weaponized the weight of the federal government to bring “lawfare” against an industry the Biden-Harris administration politically disfavors.
NSSF calls on The White House to comply with the subpoena, end its collaboration with special interest groups to deny Americans their Constitutionally-protected Second Amendment rights and abandon their support for the City of Chicago unfounded claims that amount to another example of “lawfare.”
“The White House already ignored requests to voluntarily provide this information to the House Oversight Committee. This office – led by Vice President Harris, the administration’s ‘gun control czar’ – appears to have manifested the firearm industry’s deepest concerns that it was never formed to improve community safety,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “Rather, it appears this office is a taxpayer-funded effort to do the bidding of radical, special interest groups to weaponize the courts through ‘lawfare’ and advance an agenda to deprive Americans of their Second Amendment rights, guaranteed by the Constitution. NSSF urges The White House to comply with the subpoenas and provide the information to Chairman James Comer.”
The House Oversight Committee is investigating allegations that The White House Office of Gun Violence Prevention collaborated with the antigun billionaire Michael Bloomberg’s Everytown for Gun Safety and the City of Chicago to target GLOCK, Inc., in a frivolous lawsuit, alleging the company is responsible for the criminal misuse of firearms when criminals unlawfully attach an illegal “switch” to handguns. In previous demands for information, House Oversight Committee Chairman James Comer (R-Ky.) noted, “On the very day the suit was filed, Everytown for Gun Safety President John Feinblatt posted on X, ‘Federal officials recently contacted Glock to discuss implementing new ways to modify Glock pistols to make it harder for Glock switches to be installed. Rather than help, Glock falsely insisted there is nothing they can do.’”
Chairman Comer said this indicates that Everytown had inside access to White House meetings. The White House Office of Gun Violence Prevention is staffed by a former Everytown lobbyist, Rob Wilcox. Letters demanding more information were previously sent to Steven Dettelbach, Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), and White House Office of Gun Violence Prevention Director Stefanie Feldman.
Chairman Comer sent these letters demanding answers on June 14, 2024. Instead of answering those questions, White House Deputy Counsel Rachel Cotton responded by making counteraccusations that Chairman Comer was shilling for the gun lobby. Cotton provided no answers, only listing off the Biden administration’s gun control efforts and goals, adding Congress “should open a real investigation into an actual danger to our communities: the proliferation of illegal devices that convert handguns into machineguns in a matter of seconds.”
Deputy Counsel Cotton’s response was a purposefully misleading attack on not just the House Oversight Committee but also GLOCK Inc. The devices are “autosears,” which are illegal to possess, attach to a firearm or use without compliance with the 1934 National Firearms Act (NFA). Cotton, as an attorney, should know that these aren’t produced by GLOCK Inc. or any other firearm manufacturer. In fact, they are largely illegally imported from China or illegally manufactured by individuals.

NSSF Opposes Interior Department Proposal to Close 1.3 Million Acres of Bears Ears National Monument
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, strongly opposes Interior Secretary Deb Haaland’s proposed plan for the Department of the Interior to shutter access to recreational shooting on 1.3 million acres of the Bears Ears National Monument, in Utah. Today’s announcement will needlessly deny recreational target shooters access to the monument for no legally justifiable purpose and will violate federal law.
“Secretary Haaland’s proposed plan to close access to 1.3 million acres for recreational shooting is a violation of federal law,” said Joe Bartozzi, NSSF President and Chief Executive Officer. “Public lands must be made available for all the public to use. Federal law explicitly states that when closures of public lands are necessary, they must be limited in area and duration to achieve a specific stated objective. Secretary Haaland has articulated none of the required criteria, as required by law. The Secretary should rescind or drastically modify this misguided policy and apply the law as intended: to benefit the public.”
The John D. Dingell, Jr., Conservation, Management, and Recreation Act, which was signed into law in 2019, sets the criteria upon which the Secretary of the Department of the Interior may close public access to public lands. The law limits the area and duration for when public access to federal lands may be closed. Closures may only occur when a clear and quantifiable objective is identified. Secretary Haaland’s announcement to close 1.3 million acres to Bears Ears National Monument fails to meet these requirements.
The Dingell Act states that federal lands will remain open to hunting, fishing and recreational shooting in accordance with applicable law. That is, unless the Secretary establishes that a specific area must be closed for one or more particular reasons, including public safety, administration or compliance with applicable laws. If that is to occur, the Secretary must limit the closure to the smallest area necessary and for the shortest amount of time to achieve the stated purpose.
None of these criteria were met before Secretary Haaland announced that public access will be denied to countless recreational shooters who, since the land is public, own those lands. The announcement will deny access in a manner detrimental to conservation funding. What is most appalling is that this punitive political action is occurring despite the absence of any indication that recreational shooters pose an any viable threat to the monument’s cultural, historic or natural resources.
“NSSF is deeply troubled by this blatant violation of the law to close off access to 1.3 million acres of public land,” Bartozzi added. “This unlawful closure demonstrates that the Biden-Harris administration and Secretary Haaland are openly hostile to the interests of America’s sportsmen and women. This action clearly shows utter disdain for the rule of law. NSSF will protest this proposal and will work with the Bureau of Land Management to ensure future shooting opportunities in the Monument remain available to recreational target shooters.”
NSSF encourages all Americans who enjoy access to public lands to comment on this proposal and to make their voices heard.
