NSSF Files Amicus Brief Urging SCOTUS to End Mexico’s Firearm Industry Lawsuit
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, filed an amicus brief in support of Smith & Wesson, Inc., with the U.S. Supreme Court in Smith & Wesson Brands, Inc., et al., v. Estados Unidos Mexicanos. Smith & Wesson, Inc., and other industry members, petitioned the Court to reverse the U.S. Court of Appeals for the First Circuit’s decision to allow the frivolous lawsuit to proceed. Mexico’s lawsuit seeks $10 billion in damages from several U.S. firearm manufacturers for the crimes committed by narco-terrorist cartels in Mexico. Mexico alleges that U.S.-based firearm manufacturers are liable for the harm caused by lawlessness in their country and the government corruption that allows it to fester.
NSSF argues that the First Circuit erred in its decision to allow the lawsuit to proceed. The Protection of Lawful Commerce in Arms Act (PLCAA) specifically prohibits lawsuits of this nature that intend to saddle firearm businesses with the liability for the criminal misuse of firearms by remote third parties.
“Congress enacted the PLCAA in 2005 to put a stop to these efforts to use novel tort theories to destroy a lawful industry and the fundamental rights it facilitates,” the brief states, later adding, “Mexico’s counsel was the architect of many of the lawsuits that were brought before the PLCAA. And he has been quite candid that this lawsuit is yet another effort to work ‘outside’ the ‘constrain[ts]’ of ‘U.S. politics,’ the Second Amendment, and this Court’s decisions in Heller and Bruen, which (in his view) ‘were wrongly decided and need to be reversed.’”
NSSF’s brief to the Supreme Court also points out that Mexico’s lawsuit infringes on U.S. sovereignty by attempting to dictate the limits of Second Amendment rights and how the U.S. firearm industry is regulated. NSSF specifies that Mexico’s lawsuit is “focused on trying to impose a de facto ban” on Modern Sporting Rifles (MSRs) – or the AR-15-style rifle – and standard capacity magazines.
“As explained here and in petitioners’ brief, Mexico’s lawsuit implicates almost every hot-button issue in U.S. firearms policy and would leverage our court system to allow a foreign government to pretermit a range of debates currently underway in Congress and statehouses throughout the Nation,” the amicus states. “Rejecting that effort, and the First Circuit’s decision rubber-stamping it, will send an unmistakable signal to cities, states, and lower courts intent on undermining the Second Amendment—which is exactly what Congress enacted the PLCAA to prevent.”
The PLCAA was signed into law in 2005 by President George W. Bush with broad bipartisan support by Congress. The law was spurred by numerous frivolous lawsuits orchestrated by gun control groups to circumvent Congress and put firearm companies out of business based on the criminal misuse of firearms by remote individuals who lack respect for both life and law. The PLCAA has been repeatedly upheld as Constitutional by federal courts.

WASHINGTON – If you are considering a drone as a holiday gift, the Federal Aviation Administration (FAA) wants you and your loved ones to understand how to fly it safely.
The FAA is again launching its 12 Days of Drones campaign to educate people about the rules, regulations and best practices of operating a drone.
This December, the agency will share important drone-safety information and resources that will help future pilots – including those flying for fun – stay up to date with the latest rules. The FAA will post all of the campaign’s safety messages on its FAADroneZone X (formerly Twitter) and Facebook accounts throughout the month.
The campaign will run each weekday from December 9 – 24 with each day dedicated to a specific drone safety topic.

GA-ASI AWARDED NEXT GEN HF MODEM CONTRACT
SAN DIEGO – 04 December 2024 – General Atomics Aeronautical Systems, Inc. (GA-ASI) was awarded a contract on October 4, 2024, to develop a next generation high-frequency (HF) modem for the U.S. Naval Information Warfare (NAVWAR) Program Executive Office Command, Control, Communications, Computers and Intelligence (PEO C4I). The task order was issued by the Naval Information Warfare Center (NIWC) Pacific.
GA-ASI will develop a cost-efficient, software-defined Generation 2 HF modem that meets U.S. Navy ship, sub, and shore environmental requirements and supports a rapid fielding schedule. GA-ASI will provide waveform and modem development, test and evaluation, as well as onsite technical assistance for the NAVWAR PEO C4I program.
“The Gen2 Modem delivers the security and resilience the U.S. Navy needs for its tactical radio fleet modernization efforts,” said Jeff Hettick, GA-ASI vice president of Agile Mission Systems. “These modems will be the heart of the HF system, providing high-speed, long-range HF communications that meets the Navy’s demanding program of record requirements, which includes beyond-line-of-sight communications in a satellite-denied environment.”
The work will be performed by GA-ASI over a 16-month base development timeline.

Cimarron Firearms’ latest entrée into fine Hollywood firearm replicas pays homage to actor Paul Newman, who starred in the critically acclaimed 1967 movie, Hombre.

The lead character, exceptionally portrayed by Hollywood A-lister, Paul Newman, was raised by Apache Indians and has returned to a small Arizona town to collect an inheritance. Leaving town, he boards a stagecoach in which the movie’s drama takes place. Known only as Hombre, Newman is relegated to riding up top with the drive because of his Apache background. Stagecoach robbery, duplicitous passengers, kidnapping, outlaws, and a final shoot-em-up entail. Only through the quick action of our hero, Hombre, and his hidden and highly accurate 1873 Winchester lever-action is the kidnapped victim rescued, and the passengers saved. When the smoke clears, Hombre lies mortally wounded, as a survivor asks, “I would at least like to know his name” and the coach driver mournfully replies, “His name was John Russell.”

NSSF Praises Court Decision to Uphold PLCAA
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, praised the San Diego County Superior Court’s decision to grant summary judgment in favor of Smith & Wesson, Inc. under the Protection of Lawful Commerce in Arms Act (PLCAA). The court decided today that Smith & Wesson, Inc. is not responsible for the horrendous criminal acts committed by a deranged murderer at the Chabad of Poway, in Poway, Calif., on April 27, 2019.
The PLCAA protects the firearm industry from frivolous lawsuits that attempt to hold firearm businesses liable for the criminal misuse of lawfully sold firearms.
“We are heartened by the court’s decision today correctly interpreting the PLCAA and ruling in favor of Smith & Wesson, Inc. that the criminal liability for the horrific actions of a murderer are the sole responsibility of that individual,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “Plaintiffs in this case attempted to hold Smith & Wesson, Inc. responsible for these horrific crimes by alleging that because the firearm could be illegally modified, the company violated federal law. Additionally, plaintiffs alleged Smith & Wesson, Inc.’s advertising caused the murderer to commit his violent crimes. The firearm industry is grateful that the judge found these claims lack legal merit and correctly granted judgment in favor of Smith & Wesson, Inc.”
NSSF earlier in the case filed an amicus brief in support of Smith & Wesson, Inc.
The murderer in this incident was convicted and sentenced by a California state court to life in prison, without the possibility of parole. The sentence carried an additional 121 years to life, plus 16 years as part of a plea agreement. The murderer was also convicted by a federal court and sentenced to life in prison without the possibility of parole, plus 30 years.
The PLCAA was signed into law in 2005 by President George W. Bush with broad bipartisan support by Congress. The law was spurred by numerous frivolous lawsuits orchestrated by gun control groups to circumvent Congress and put firearm companies out of business based on the criminal misuse of firearm by remote individuals who lack respect for both life and law. The PLCAA has been repeatedly upheld as Constitutional by federal courts.

NICS Checks Top 613,000 for ‘Black Friday’ Week
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, revealed that the FBI’s National Instant Criminal Background Check System (NICS) completed 613,380 background checks related to firearms for the week leading up to, and including, “Black Friday,” one of the busiest shopping days of the year. That figure is down from 2023’s total of 680,671 for the same time period. The 2024 total is a 9.8 percent decrease from the 2023 figure.
FBI NICS completed 169,906 background checks on “Black Friday” alone. The figure approximates firearm sales at retail on that day, although it also includes background checks for other purposes related to firearms such as approvals for concealed carry permits. NSSF will later this week release its Adjusted NICS figures for November reflecting only those background checks related to the sale of a firearm at retail.
NSSF has worked with firearm retailers to spread out special sales offers to customers throughout the week leading up to “Black Friday” so as not to overwhelm FBI NICS on a single day, which can result in longer than normal wait times.
“The background checks reported by the FBI are in keeping with the trends NSSF has seen throughout the year. While the overall trends are still coming off the peaks experienced in recent years, firearm sales remain consistently strong, with over a million per month for more than five years running,” explained Joe Bartozzi, NSSF President and CEO. “These figures tell us that there is a continued strong appetite for lawful firearm ownership by law-abiding Americans and that firearm manufacturers across the country continue to deliver the quality firearms our customers have come to expect.”
Annual background check data shows that firearm sales will typically rise during the final months of the year coinciding with hunting seasons and holiday sales.
