NSSF Commends House and Senate Veterans 2nd Amendment Protection Act Introductions

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, commends the introduction of the Veterans 2nd Amendment Protection Act in the U.S. House of Representatives and U.S. Senate. U.S. Rep. Mike Bost(R-Ill.), Chairman of the House Committee on Veterans Affairs, along with Rep. Morgan Lutrell (R-Texas), introduced H.R. 1041, and Sen. John Kennedy (R-La.), along with Sen. Jerry Moran (R-Kan.), Chairman of the Senate Committee on Veterans Affairs, introduced S. 478. The two pieces of legislation would ensure that no Department of Veterans Affairs (VA) bureaucrat can strip a veteran with a fiduciary of their rights to keep and bear arms without a judge or court ruling first that the veteran is a danger to themselves or their community.

Chairman Bost’s bill has 40 cosponsors. Sen. Kennedy’s legislation has 15 cosponsors.

“This legislation will ensure that veterans are not improperly added as a prohibited person on the FBI’s National Instant Criminal Background Check System simply because they need assistance with financial matters. Needing a fiduciary alone does not disqualify a veteran from legally purchasing a firearm at retail,” said Lawrence G. Keane, Senior Vice President and General Counsel, NSSF. “We owe our freedoms to veterans who fought to preserve all our rights. Congress should ensure that veterans’ Second Amendment rights are protected when it comes to the Department of Veterans Affairs. NSSF is grateful for the leadership and advocacy of Chairman Bost, Senator Kennedey and Senator Moran, on behalf of veterans.”

NSSF has been a longtime advocate to fix this bureaucratic oversight that has resulted in veterans’ names being submitted to the FBI’s National Instant Criminal Background Check System (NICS) because they are in need of a fiduciary, or someone to assist with their finances. Needing a fiduciary is not a prohibiting factor to deny any individual the ability to legally purchase or possess a firearm. No one – much less a law-abiding veteran – should have their ability to lawfully acquire a firearm at retail – without Due Process.

This issue of veterans’ names being submitted to FBI NICS as prohibited individuals was suspended in the FY 2024 MilCon/VA Approporations bill and subsequent two continuing resolutions. However, that is a temporary fix that will expire on March 14, 2025. This legislation, introduced both in the House and Senate, would resolve this bureaucratic oversight by protecting the Second Amendment rights of veterans who have served their nation to defend those rights for all.

This is an important message from the Bureau of Alcohol, Tobacco, Firearms and Explosives. All FFLs should be aware that Machinegun Conversion Devices (MCDs) is a part, or a combination of parts, designed to modify a semi-automatic firearm so it is capable of firing automatically more than one shot by a single function of the trigger. These devices, often called switches, chips, auto sears are considered machineguns under the law. The possession, manufacture, and/or sale of machinegun conversion devices without proper licensing is a federal offense.

Please see the attach flyer which illustrates different Machinegun Conversion Devices (MCDs). These devices are defined as machineguns under the National Firearms Act, even when not installed. We encourage FFLs who encounter these devices to immediately contact your local law enforcement office or nearest ATF office.

NSSF Files Amended Claim Against New Jersey Anti-PLCAA Law Allowing Frivolous Lawsuits

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, filed an amended complaint against New Jersey’s anti-Protection of Lawful Commerce in Arms Act (PLCAA) law that is not “consistent with the Constitution.”

NSSF filed a motion to reopen the NSSF v. Platkin case and for leave to file an amended complaint today in the U.S. District Court for the District of New Jersey. The motion and amended complaint were filed after New Jersey’s Attorney General Matthew J. Platkin brought a lawsuit against GLOCK, Inc., alleging the company is responsible for the criminal misuse of firearms when criminals modify and alter well-designed and lawfully-sold GLOCK pistols by illegally obtaining, possessing and installing a “switch” into the handgun.

NSSF previously sued to block New Jersey’s law from taking effect, but that challenge was dismissed by a three-judge panel for the U.S. Court of Appeals for the Third Circuit because the court determined that NSSF lacked standing at the time to challenge the law. The Office of Attorney General Platkin disavowed to the appellate court that it had any intention of suing firearm manufacturers for engaging in lawful commerce or placing liability on firearm manufacturers for the criminal misconduct of third parties beyond their control. They promised to only sue for a company’s own misconduct. In dismissing the case, Judge Stephanos Bibas wrote, “[W]e see little evidence that enforcement is looming. Because the Foundation has jumped the gun, its challenge must be dismissed.”

That has all changed now that Attorney General Platkin is seeking to enforce this unconstitutional anti-PLCAA law against GLOCK, Inc., and other industry members.

“As feared, Attorney General Platkin has weaponized the judicial system against firearm manufacturers who have done nothing but engage in lawful commerce and have not violated any federal or state statutes. New Jersey is seeking to blame GLOCK and other industry members for the actions of criminals,” said Lawrence G. Keane, NSSF’s Senior Vice President and General Counsel.

NSSF’s amended complaint argues that New Jersey’s public nuisance law flouts the will of Congress and undermines the U.S. Constitution because it is preempted by the bipartisan PLCAA. Additionally, it violates the First Amendment, Second Amendment, Due Process Clause and the Commerce Clause.

Keane said, “Attorney General Platkin’s lawsuit is the very definition of ‘lawfare’ and should be rejected by the court. The statute should be struck down as unconstitutional.”

New Jersey Attorney General Platkin’s frivolous lawsuit against GLOCK was filed shortly after the now- shuttered Biden-Harris White House Office of Gun Violence Prevention colluded with Everytown for Gun Safety to sue GLOCK on behalf of the City of Chicago advancing the same claim based on a similar Illinois statute. Once Chicago sued, Attorney General Platkin and a group of 15 other states threatened to sue GLOCK.

New Jersey has now followed through on its threat. NSSF now unquestionably has standing to revive its case that was dismissed without prejudice.

NSSF is separately challenging the constitutionality of the Illinois statute.

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, praises U.S. Rep. Andy Barr’s (R-Ky.) introduction of the Fair Access to Banking Act, H.R 987, which will end the discriminatory lending practices of major banking institutions that seek to circumvent the legislative process, set social policy from the boardroom and prevent banking regulators from inappropriately pressuring banks to debank politically disfavored industries.

The Fair Access to Banking Act would require banks to provide access to services, capital and credit based on the objective risk assessment of individual customers, rather than subjective broad-based decisions affecting whole categories or classes of customers.

“Congressman Barr’s ‘Fair Access to Banking’ bill is vital to ensure financial service providers aren’t discriminating against lawful industries like the firearm industry to score points with the ‘woke’ cancel culture. This legislation will ensure financial institutions, when deciding whether or not to offer services to fully legal and lawful businesses, make such decisions based upon verifiable financial data and not on the political or social views of a few bank executives,” said Lawrence G. Keane, NSSF’s Senior Vice President and General Counsel. “The banking industry has benefited from taxpayer bailouts and taxpayer-funded insurances, and it is unacceptable that these same banking institutions believe they can arbitrarily deny services to legal, constitutional businesses such as our industry, which gainfully employs millions of Americans and helps guarantee the right to keep and bear arms. The firearm industry thanks Representative Barr for his leadership to guarantee all legal and regulated American companies have fair and uniform access to financial services.”

The Fair Access to Banking Act would stop corporate banks from picking winners and losers based on executives’ personal politics. It also protects banks from outside pressure by special interest groups seeking to use the banks as a political weapon to advance their agenda.

Corporate banks have privatized “Operation Choke Point,” the illegal discrimination scheme that began under the Obama-Biden administration. The Department of Justice (DOJ) and Federal Deposit Insurance Corporation (FDIC)-led effort, directed financial institutions to deny entire industries access to services, including the firearm industry. Despite being a Constitutionally-protected industry, the Obama-Biden administration illegally coerced banks to end existing business relationships and deny new ones.

After the illegal practice was ended under the Trump administration, banks and special interest advocates privatized this scheme by adopting policies that specifically denied firearm businesses financial services for the sole reason of being in the business of selling certain types of lawful firearms. They forced these discriminatory practices while exploiting taxpayer-funded resources like FDIC insurance protections. There are now credible claims that under the Biden administration, banking regulators again began pressuring banks to debank certain industries.

Similar legislation, with the same title and also supported by NSSF, was introduced in the U.S. Senate by Sen. Kevin Cramer (R-N.D.) as S. 401. NSSF Applauds U.S. Sen. Kevin Cramer’s Fair Access to Banking Act Introduction

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, applauded U.S. Sen. Kevin Cramer’s (R-N.D.) introduction of the Fair Access to Banking Act, S. 401, which will end the discriminatory lending practices of major banking institutions that seek to circumvent the legislative process, set social policy from the boardroom and prevent banking regulators from inappropriately pressuring banks to debank politically disfavored industries. The legislation has 40 co-sponsors.

The Fair Access to Banking Act would require banks to provide access to services, capital and credit based on the objective risk assessment of individual customers, rather than subjective broad-based decisions affecting whole categories or classes of customers.

“Senator Kevin Cramer’s ‘Fair Access to Banking’ legislation is a bold and principled stand that will put an end to ‘woke’ financial discrimination,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “This legislation will ensure financial institutions make decisions to offer services to lawful businesses based on objective and verifiable financial data and not the shifting of political or social views of banking executives or regulators that are unaccountable to the American voter. For too long, banking institutions have arbitrarily denied services to legal and Constitutionally-protected businesses to advance a politically-driven agenda or yielded to inappropriate political pressure from ‘woke’ banking regulators. This includes denying critical financial services to the firearm industry that provides the means for law-abiding citizens to exercise their Second Amendment rights. The firearm industry thanks Senator Cramer for leading the charge to guarantee all lawful and regulated American companies have fair and uniform access to financial services as required by Federal law.”

The Fair Access to Banking Act would stop corporate banks from picking winners and losers based on executives’ personal politics. It also protects banks from outside pressure by special interest groups seeking to use the banks as a political weapon to advance their agenda.

Corporate banks have privatized “Operation Choke Point,” the illegal discrimination scheme that began under the Obama-Biden administration. The Department of Justice (DOJ) and Federal Deposit Insurance Corporation (FDIC)-led effort directed financial institutions to deny entire industries access to services, including the firearm industry. Despite being a Constitutionally-protected industry, the Obama-Biden administration illegally coerced banks to end existing business relationships and deny new ones.

After the illegal practice was ended under the Trump administration, banks and special interest advocates privatized this scheme by adopting policies that specifically denied firearm businesses financial services for the sole reason of being in the business of selling certain types of lawful firearms. They forced these discriminatory practices while exploiting taxpayer-funded resources like FDIC insurance protections. There are now credible claims that under the Biden administration, banking regulators again began pressuring banks to debank certain industries.

Like its predecessor, the ROMEO4XT-PRO is IPX8-rated for waterproof and fog proof performance and is tested to MIL-STD-810 to ensure reliable service.

ASA: How Many Suppressors Are There in the United States

WASHINGTON, D.C. — Yesterday, Monday February 3rd, Senator Mike Crapo (R-Idaho), joined by 25 cosponsors in the Senate, reintroduced the ASA-supported Hearing Protection Act in the Senate as S.364. 

This introduction builds on the momentum of pro-2nd Amendment and pro-suppressor legislation introduced in the 119th Congress. Recently, Representative Ben Cline (R-Virginia) introduced the House of Representatives version of the Hearing Protection Act. Both bills would remove suppressors from the burdensome requirements of the National Firearms Act (NFA) and require purchasers to pass an instant NICS check, the same background check used during the sale of long guns. This change, by cutting through red tape, will make it much easier for law-abiding hunters and sportsmen to access these critical hearing safety devices. The ASA fully endorses both of these bills and looks forward to seeing their passage through both chambers of Congress.

In addition, last week, Representatives August Pfluger (R-Texas) and Jared Golden (D-Maine) introduced the PARTS Act, which is a bipartisan proposal aimed at reforming the outdated definition of “firearm silencer” under the Gun Control Act.

“We are grateful to Senator Crapo for standing behind the millions of law-abiding gun owners with his introduction of the Hearing Protection Act,” said Knox Williams, president and executive director of the American Suppressor Association. “It’s absurd that our unrestrained federal bureaucracy requires Americans to jump through hoops to buy simple hearing protection devices. Momentum continues to grow for common sense reforms that would end the stranglehold of government on the rights of her people. We look forward to working with Senator Crapo and his colleagues to ensure our Second Amendment rights remain a priority.”
